These Terms and Conditions (“Terms”) form the agreement between the participant (“you”, “your”) and Ben Garratt Photography (“the Company”, “we”, “us”, “our”) for participation in any photography workshop or related service.
By booking a workshop, you confirm you have read, understood, and agreed to these Terms.
TERMS & CONDITIONS — BEN GARRATT PHOTOGRAPHY
1. BUSINESS INFORMATION
Business Name: Ben Garratt Photography
Location / Legal Jurisdiction: Warwickshire, England All services are governed by the laws of England and Wales, regardless of the physical workshop location.
2. WORKSHOP DESCRIPTION
“All in One Masterclass Workshops” include:
A full on-location photography day (approx. 7 hours)
Free access to the complete online waterfall post-processing course, hosted on our member-only website area
Lifetime access to the private Ben Garratt Photography Facebook Group
A downloadable Workshop Workflow PDF
3. PAYMENT TERMS
A non-refundable deposit is required at the time of booking to secure your place.
The remaining balance must be paid no later than 7 days before the workshop date (with the workshop day being Day 0).
Bookings made within 7 days of the workshop require full payment at the time of booking.
Failure to pay the remaining balance by the deadline may result in cancellation of your place without refund of the deposit.
4. CANCELLATION & REFUND POLICY (PARTICIPANT-INITIATED)
4.1 Cancellation more than 7 days before the workshop
You will forfeit only the non-refundable deposit.
Any additional payments made will be refunded.
4.2 Cancellation 7 days before the workshop date
(7 days before meaning Day –7, with Day 0 being workshop day)
You forfeit the non-refundable deposit plus 50% of the remaining balance.
The other 50% of the remaining balance will be refunded.
4.3 Cancellation within 48 hours of the workshop
No refunds will be issued.
You forfeit 100% of the workshop fee.
4.4 No-show
Failure to attend the workshop without prior communication will result in forfeiture of 100% of the workshop fee.
No refunds, credits, or transfers will be provided.
5. RESCHEDULING POLICY (PARTICIPANT-INITIATED)
5.1 Rescheduling 14 days or more before the workshop
You may transfer to a new date free of charge.
Your deposit will be transferred to the new date.
The new date must be within 3 months of the original workshop date.
5.2 Rescheduling within 14 days of the workshop
Allowed, but subject to a £25 rescheduling fee.
5.3 Rescheduling within 48 hours of the workshop
Not permitted.
You will forfeit 100% of the workshop fee.
5.4 No-show
Treated as a late cancellation; no refunds or transfers will be provided.
6. WORKSHOP LEADER-INITIATED CANCELLATIONS
Workshops may occasionally be postponed or cancelled by the workshop leader due to various circumstances, including but not limited to severe weather, illness, personal health issues, or emergencies.
6.1 Weather-Related Cancellations
Workshops may be postponed or cancelled due to unsafe conditions, including high winds or flash flood warnings.
Participants may choose:
A full refund of all payments, OR
Transfer to a rescheduled date at no extra cost.
Workshops will continue in light or moderate rain unless conditions become unsafe.
6.2 Illness
If the workshop leader is unable to run the workshop due to illness, participants may choose:
A full refund of all payments, OR
Transfer to a rescheduled date at no extra cost.
6.3 Personal Health & Emergencies
If the workshop leader must cancel due to personal health issues or unforeseen emergencies (e.g., family emergency, accident), participants may choose:
A full refund of all payments, OR
Transfer to a rescheduled date at no extra cost.
Every effort will be made to provide advance notice to participants.
Workshops will continue in light or moderate rain unless conditions become unsafe.
7 Locations & Itinerary Changes
7.1 Trail Access & Location Substitutions
Some waterfall trails, access paths, or sections of a location may be closed or restricted due to:
Trail maintenance
Conservation work
Safety concerns
Weather damage
Other unforeseen circumstances beyond our control
If a planned waterfall or section of a trail becomes inaccessible, Ben Garratt Photography reserves the right to:
Substitute that location with an alternative waterfall or shooting spot
Use another location on the same trail or within the same area, where reasonably possible
Location substitutions do not constitute a cancellation of the workshop.
No refunds will be issued solely due to changes in locations visited.
7.2 Workshop Itinerary & Time Adjustments
The workshop itinerary is designed to allow approximately one hour at each location, with buffer time included where possible.
Time spent at each location may vary depending on:
Group pace
Weather and conditions
Learning needs
Creative opportunities
If additional time is spent at one location, it may be necessary to:
Reduce the time allocated at a subsequent location
Adjust the order or duration of planned stops
Minor itinerary or timing adjustments made in good faith to maximise learning, safety, and overall workshop value:
Do not constitute a material change to the workshop
Do not entitle participants to refunds or partial refunds
8. MINIMUM & MAXIMUM PARTICIPANT NUMBERS
Minimum participants: 1
Maximum participants: 4
If the minimum is not met, we reserve the right to cancel or reschedule. You will receive a full refund or a transfer to another date.
9. WHAT’S INCLUDED
Personal guided photography mentoring throughout the 7-hour day
Free access to the full online waterfall post-processing course
Lifetime access to the private Facebook support group
Workshop workflow PDF
Travel, meals, insurance, and personal equipment are not included.
10. UNDER 18S
Participants under the age of 18 must be accompanied by an appropriate adult or legal guardian for the duration of the workshop.
11. HEALTH & SAFETY
A group risk assessment briefing will be conducted at the start of the workshop.
By booking a workshop and paying the deposit, you acknowledge and accept the inherent risks involved in outdoor photography, including uneven terrain, wet surfaces, and environmental hazards.
A separate Liability Release Form must be signed in person before the workshop begins; refusal to sign will result in removal without refund.
12. INSURANCE
12.1 Workshop Leader Insurance
Ben Garratt Photography holds the following insurance policies:
Public Liability Insurance
Professional Indemnity Insurance
Photography Equipment Insurance
12.2 Participant Insurance
Participants are responsible for holding their own insurance, including (where applicable):
Personal health/medical coverage
Travel insurance
Equipment loss or damage insurance
The workshop fee does not cover any participant insurance.
13. TRAVEL & TRANSPORT
Travel to and from the workshop meeting point is the responsibility of the participant.
Travel between shooting locations during the workshop is also the participant’s responsibility.
We are not responsible for delays, missed sessions, or additional costs due to travel issues.
14. EQUIPMENT RESPONSIBILITY
Participants are solely responsible for their own equipment, including cameras, lenses, tripods, bags, and personal belongings.
Ben Garratt Photography is not liable for:
Water damage
Mud damage
Falls, drops, or impact damage
Loss or theft
Outdoor locations inherently expose equipment to risk.
15. IMAGE OWNERSHIP & USAGE
15.1 Participant Image Rights
You retain full copyright ownership of all photographs you capture during the workshop.
You may use your images for:
Personal portfolio display
Personal, non-commercial social media sharing
Commercial use of images taken during the workshop is not permitted unless agreed in writing.
15.2 Workshop Leader Promotional Usage
By attending the workshop, you grant Ben Garratt Photography the irrevocable, non-commercial right to use photographs or video taken of you during the workshop for promotional and advertising purposes (website, social media, flyers, etc.).
If you wish to opt out, you must notify the workshop leader before the workshop begins.
16. INTELLECTUAL PROPERTY
All teaching materials, including the online course, PDFs, demonstrations, videos, and guidance provided during the workshop or online portal, remain the exclusive copyright of Ben Garratt Photography.
Participants may not:
Copy
Share
Distribute
Reproduce
Resell
any workshop or online course materials. Access is for the registered participant only.
17. CODE OF CONDUCT
17.1 Safety & Compliance
Participants must:
Follow all instructions, directions, and safety advice from the workshop leader
Report hazards, injuries, or dangerous situations immediately
Stay within designated paths and avoid restricted areas
Recognise and work within their own physical limits
Failure to comply may result in removal without refund.
17.2 Environmental Stewardship (“Leave No Trace”)
Participants must:
Leave the environment exactly as they found it
Carry out all waste, litter, and belongings
Avoid disturbing wildlife
Prioritise the wellbeing of nature over getting a photograph
17.3 Group & Location Etiquette
Participants must:
Respect other photographers’ space and compositions
Not set up equipment in front of others
Be courteous to the public and other visitors
Avoid photographing identifiable individuals without consent
Maintain a positive, respectful attitude toward everyone
17.4 Breach & Enforcement
Participants who violate the Code of Conduct, engage in unsafe behaviour, or disrupt the workshop may be removed at the workshop leader’s discretion.
No refunds or credits will be given for removal due to misconduct.
18. LIMITATION OF LIABILITY
Ben Garratt Photography is not liable for:
Personal injury (except where caused by negligence)
Property damage or equipment loss
Travel disruptions or expenses
Indirect or consequential losses
Our total liability shall not exceed the amount you paid for the workshop.
19. ACCEPTANCE OF TERMS
By booking and attending a workshop, you confirm that you:
Have read and understood these Terms
Agree to be bound by them
Acknowledge all associated risks and responsibilities
